Position summary: The Senior Manager of Litigation & E-Discovery Forensics will manage and develop LEDS' data forensic and collection services team and provide forensic consulting to Cooley litigation attorneys and clients on the multitude of data sources that could contain electronic evidence. This Senior Manager will oversee and provide data collection and forensic services and will formulate and implement defensible data collection procedures to ensure adequacy and accuracy of the process in litigation and investigations. This position will also ensure effective documentation of data collection processes and tracking electronic evidence is maintained. In addition, this senior manager will be responsible for managing LEDS professional staff who support firm-wide source code reviews. Duties include, but are not limited to, the following:

Position responsibilities:

  • Lead and develop the LEDS department's data forensic and collection team to provide data forensic analysis and collection consulting and data governance services to Cooley litigation teams and clients
  • Provides subject matter expertise, leadership and innovation to enhance e-discovery identification, preservation and collection workflows for existing and new technologies
  • Design and implement defensible and technically sound data collections and workflows from client or third-party systems and applications, including, cloud-based repositories and mobile devices
  • Provide consulting and advice to legal teams and clients to develop defensible data collection protocols, project plans and searching, testing and sampling protocols
  • Develop and maintain information on current best practices and emerging trends in digital forensics and defensible data collection
  • Stay current and abreast of new data sources and technologies that create and store electronic information that may be needed in litigation. Also stay current with e-discovery legal developments and processes related to preserving and collecting information in a defensible manner
  • Design and offer educational programs to support Cooley litigation attorneys and clients on emerging technology and data governance
  • Use leading forensic software to identify, collect, preserve, and analyze electronic data from laptops, desktops, servers, backup tapes, mobile devices and a wide variety of other media, including new and developing technologies and platforms
  • Manage, track, and create documentation and chain of custody logs of collected electronic information for litigation purposes. Maintain and ensure others maintain detailed project-related notes and documentation regarding data collection processes and work performed on litigation related client data, from receipt or collection through conclusion of matter in department workflow documentation tool or other centralized repository
  • Assist with technology vendor management and communication to ensure best practice compliance and to reduce cost
  • Design and implement workflows for data reduction and culling in litigation matters
  • Manage LEDS staff who support source code review, including configuring, deploying and managing physical and virtual systems upon which source code will be reviewed
  • Ensure staff maintain highly detailed project-related notes and documentation related to source code reviews
  • Ensure firm policies and procedures related to source code reviews are followed, including ensuring proper security protocols and working with case teams on protective orders regarding source code reviews
  • Assist legal teams with project planning and development of source code related document review protocols, searching, testing and sampling and all aspects of source code review and production
  • Develop process documentation and user training materials directed by LEDS management
  • Troubleshoot issues as they arise with litigation teams, data collections, source code related systems, and processes
  • Follow department policies and procedures related to data collection, source code review policy, litigation data management and all aspects of litigation support
  • Adhere to firm wide client/matter data classification and management standards in identification of client related data
  • Substantial billable time expected
  • Provides leadership in the development of strategic approaches for the defensible collection of emerging data sources

Skills and experience:

  • Bachelor's Degree with preferred concentrations in Computer Science, Engineering, Information Technology, or Management of Information Systems
  • 7+ years experience handling forensically data collections from custodian and network data sources, including cloud-based repositories
  • Conversant with electronic discovery and risk management issues, concepts and legal processes.
  • Possess some forensic and collection certifications such as: SCERS, CFCE, CCE, EnCE, ACE, CEECS or comparable certification
  • Experience with administration of native applications, multiple versions of Window operating systems and other OS, including but not limited to Mac and Linux based systems
  • Ability to program in languages such as: C#, Java, Python, Pearl, Bash scripting, PHP, etc and experience with desktop engineering, knowledge of scripting. SQL and Network servers
  • Must be highly proficient with standard computer equipment, laptops and printers
  • Strong hardware and software troubleshooting technical experience
  • Must be familiar with all aspects of software interaction with network systems and business application systems
  • Thorough understanding of forensically sound data collection tools and processes, relational databases, Microsoft Access, litigation support related software and technology, and possess deep understanding of desktop and network operating systems
  • Ability to create detailed, process-oriented documentation of all collection and source code related work
